1. Acceptance of these Terms
By accessing or using livefair24.com (the "Site"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use the Site. These Terms apply to all visitors, regardless of location, with additional jurisdiction-specific terms in Sections 13 and 14 below applying depending on where you access the Site from.
2. Who operates this Site
This Site is operated by S.M. Moshtaghi, Ingeborg-Bachmann-Straße 12, 28816 Stuhr, Germany ("we", "us", "our"). Full contact and regulatory details are available in our Impressum.
3. What this Site is — and what it is not
LiveFair24 is an independent search and comparison platform. We display event listings, ticket prices, and hotel availability sourced in real time from third-party ticketing platforms (such as Ticketmaster) and third-party hotel/travel providers. We do not sell tickets, hotel rooms, or any other product directly. We are not a ticket seller, box office, event organizer, hotel, or travel agency.
When you click "Get tickets," "Book," or a similar link on this Site, you are redirected to a third-party provider's own website. Any purchase, booking, or transaction you complete happens entirely between you and that third party, under that third party's own terms, prices, and policies — not ours. We are not a party to that contract.
We may earn a commission when you make a purchase through a link on this Site. This never affects the price you pay. See our Affiliate Disclosure for details.
4. Accuracy of prices, availability, and listings
Prices, ticket availability, seat/section details, hotel rates, and event details shown on this Site are pulled from third-party sources and refreshed periodically. They can change at any time — including between the moment you view a page and the moment you complete a purchase on a third-party site. We do not guarantee that any price, availability, or detail shown on this Site is current, complete, or accurate. Always verify the final price, availability, and terms directly on the third-party provider's site before completing a purchase.
Estimated figures on this Site (such as local transport cost estimates or "total trip cost" calculations) are rough estimates only, are not quotes, and should not be relied upon for financial planning or purchase decisions.
5. Acceptable use
You agree not to:
- Use automated means (bots, scrapers, crawlers) to access, copy, or extract data from this Site without our prior written consent
- Attempt to interfere with, disrupt, or overburden the Site's infrastructure
- Attempt to gain unauthorized access to any part of the Site, other users' data, or our systems
- Use the Site for any unlawful purpose, or in violation of any applicable local, national, or international law
- Misrepresent your identity or affiliation, or impersonate any person or entity
- Reproduce, resell, or commercially exploit any part of the Site's content without our prior written consent
We reserve the right to restrict, suspend, or terminate access to the Site, without notice, for anyone we reasonably believe has violated these Terms.
6. Intellectual property
The Site's design, layout, original text, and underlying code are owned by us or our licensors and protected by copyright and other intellectual property laws. Event names, artist names, venue names, and related trademarks belong to their respective owners; their appearance on this Site is for identification and informational purposes only and does not imply any endorsement, sponsorship, or affiliation between us and those parties, except where explicitly stated.
7. No endorsement or partnership implied
Reference to any third-party provider (ticket sellers, hotel booking platforms, payment processors, or others) on this Site does not imply that we are officially partnered with, endorsed by, or acting as an authorized agent of that provider, unless explicitly stated. Trademarks and logos of third parties, where displayed, remain the property of their respective owners.
8. Disclaimer of warranties
To the fullest extent permitted by applicable law, the Site and all content, data, and functionality on it are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability.
We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components, or that any defects will be corrected. Nothing in this Section 8 limits any statutory rights that cannot lawfully be excluded — see Section 13 for consumers in the EU/Germany specifically.
9. Limitation of liability
To the fullest extent permitted by applicable law: we shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of, or inability to use, the Site — even if we have been advised of the possibility of such damages.
We are not liable for any loss or damage arising from: (a) any purchase, booking, or transaction made with a third-party provider; (b) inaccurate, outdated, or unavailable pricing, availability, or event information; (c) the acts, errors, omissions, or insolvency of any third-party provider; (d) cancelled, postponed, or rescheduled events; or (e) any issue with a venue, seat, or hotel room once booked with a third party.
To the extent any liability cannot be excluded under applicable law, our total aggregate liability to you for any claim arising from your use of the Site shall not exceed the greater of (i) the amount of any fees you have paid directly to us in the 12 months preceding the claim (which, given we do not sell tickets or bookings directly, will typically be zero), or (ii) one hundred euros (€100) / one hundred US dollars (US$100), whichever currency is applicable to your claim.
10. Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless us, our operator, and our contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: your violation of these Terms; your misuse of the Site; or your violation of any law or the rights of a third party.
11. Third-party links
This Site contains links to third-party websites that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, terms, or practices of any third-party website. We strongly encourage you to review the terms and privacy policy of every third-party site before making a purchase or providing any personal information.
12. Privacy
Our collection and use of personal data in connection with the Site is described in our Privacy Policy, which forms part of these Terms.
13. Additional terms for users in the European Union / Germany
If you access the Site from the European Union, the European Economic Area, or the United Kingdom, this Section 13 applies to you in addition to the Sections above. Where any provision of these Terms conflicts with a mandatory consumer protection right you hold under German or EU law, your statutory right prevails — nothing in these Terms limits or excludes any right that cannot lawfully be limited or excluded under German or EU consumer protection law, including the German Civil Code (Bürgerliches Gesetzbuch, BGB) and the EU Consumer Rights Directive.
Since this Site does not sell goods or services directly to you, statutory withdrawal/cancellation rights under §§ 355 ff. BGB apply, if at all, to your contract with the relevant third-party provider (e.g. the ticket seller or hotel platform) — not to any contract with us, since no such contract for the purchase of goods or services is formed between you and us.
Governing law: these Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules, without prejudice to any mandatory consumer protection provisions of the country in which you are habitually resident.
Venue: to the extent legally permissible, the courts of Bremen, Germany shall have exclusive jurisdiction over any dispute arising from these Terms. This does not affect your right, as a consumer, to bring proceedings in the courts of your own place of residence under applicable EU consumer protection rules.
Online dispute resolution: the European Commission provides a platform for online dispute resolution (ODR), available at ec.europa.eu/consumers/odr. We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
14. Additional terms for users in the United States / Canada
If you access the Site from the United States or Canada, this Section 14 applies to you in addition to the Sections above.
Governing law: for users in the United States, these Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. For users in Canada, these Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
Binding arbitration and class action waiver: to the fullest extent permitted by applicable law, you and we agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Site shall be resolved by binding individual arbitration, and not in a class, consolidated, or representative action. You and we each waive any right to a jury trial and any right to participate in a class action lawsuit or class-wide arbitration. This arbitration provision does not apply where prohibited by applicable law, including certain consumer protection statutes in specific US states or Canadian provinces — where it does not apply, disputes may be brought in the applicable courts described above.
California users: under California Civil Code §1789.3, California residents are entitled to know that they may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
Nothing in this Section 14 limits any consumer protection right that cannot lawfully be waived under the law of your US state or Canadian province of residence.
15. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms, to the extent permitted by applicable law.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
